Why do we collect your personal information?

We treat the information which provides us with the following purposes:

Primary purposes:

Information about our activities: answering calls, answering e-mails or text messages (SMS, WhatsApp and/or Telegram); as well as queries made through forms, chat sessions and other features of our website: www.swissports.ch ).
Management of participation in sports and cultural events, concerts and trips, as well as their monitoring, documentation and invoicing.
Compliance with legal, accounting, tax and administrative obligations.
Secondary purposes:
Management advertising sending of products and services from the responsible of the treatment, by all the available channels (for example, SMS, WhatsApp, Twitter, ...).
Managing the use of the "customer area" of our website: by the authorized people for this purpose.

For the purposes mentioned above, the Data Controller will process all or part of the following categories of data:

The personal data requested are obligatory, in such a way that the refusal to supply them could mean the impossibility of fulfilling the purposes for which they are processed.

You guarantee that the data provided are true, accurate, complete and up to date, being responsible for any damage or injury, direct or indirect, that may occur as a result of the breach of such obligation.

In the event that you provide us with data from third parties, you must have their consent and undertake to transfer this information to them and exempt the Controller from any responsibility in this regard. However, the Data Controller may carry out verifications to verify this fact, adopting the corresponding due diligence measures, in accordance with data protection regulations.

What is the legitimacy for the treatment of personal information?

We treat your data according to the following legal bases:

The consent given by you expressly, freely and unequivocally after having been informed in detail of the purpose(s) by the Data Controller.

To whom may we disclose your personal information?

How long do we store your personal information?

We only store your personal information to the extent that we need it in order to be able to use it for the purpose(s) for which it was collected, and according to the legal basis of the processing.

The maximum storage period will be 5 years from the end of the legal relationship with the owner of the personal data. However, the following specific storage periods shall apply:

Information about our services: until the resolution of requests for information.

Management of candidiasis: 2 years from the time the CV is sent to the person in charge of processing.

Management of subscription to the "customer area" of the website: 3 years from the last login, or until you express your wish not to continue subscribing to the blog (whichever comes first).

We will keep your personal information as long as you do not exercise the rights of suppression, cancellation and/or limitation of the treatment of your data. In these cases, we will keep the information properly blocked, without giving it any use, as long as it may be necessary for the exercise or defence of claims or it may derive some type of judicial, legal or contractual responsibility of its treatment, which must be attended to and for which its recovery is necessary.

How do we protect your personal information?

3.¿Qué categorías de datos tratamos?

Atendiendo a las finalidades antes mencionadas, el Responsable del Tratamiento, tratará todas o parte de las siguientes categorías de datos:

Datos identificativos: nombre, apellidos, dirección postal, dirección de correo electrónico, teléfono, firma y número de seguridad social.
Características personales: estado civil, fecha de nacimiento, lugar de nacimiento, sexo, nacionalidad, lengua materna, datos de familia.
Circunstancias sociales: características de alojamiento/vivienda, situación familiar y propiedades.
Datos económicos, financieros o bancarios y de seguros: datos bancarios y seguros.
Datos académicos y profesionales: formación/titulaciones, historial de estudiante, experiencia profesional, pertenencia a colegios o asociaciones profesionales, en el caso de los procesos de selección.
Identificadores en línea.
Datos de tráfico y localización.
Metadatos de comunicaciones electrónicas.

Los datos personales solicitados son obligatorios, de tal forma que la negativa a suministrarlos podría suponer la imposibilidad de cumplir con las finalidades paras la que son tratados.

Usted es garante que los datos aportados son verdaderos, exactos, completos y actualizados, siendo responsable de cualquier daño o perjuicio, directo o indirecto, que pudiera ocasionarse como consecuencia del incumplimiento de tal obligación.

En caso de que nos facilite datos de terceros, deberá contar con el consentimiento de estos comprometiéndose a trasladarle la presente información y eximiendo al Responsable del Tratamiento de cualquier responsabilidad en este sentido. No obstante, el Responsable del Tratamiento podrá llevar a cabo las verificaciones para constatar este hecho, adoptando las medidas de diligencia debida que correspondan, conforme a la normativa de protección de datos.

4.¿Cuál es la legitimación para el tratamiento de la información personal?

Tratamos sus datos según las siguientes bases legales:

a) El consentimiento prestado por usted de forma expresa, libre e inequívoca tras haber sido informado pormenorizadamente de la/s finalidad/es por el Responsable del Tratamiento.

Recuerde que los datos que nos facilita y/o le solicitamos son adecuados, pertinentes y estrictamente necesarios y que, en ningún caso, está obligado a ello; y que, su no comunicación, podrá afectar el cumplimiento de la/s finalidad/es perseguidas

b) La preparación y/o ejecución de la relación contractual entre usted y el Responsable del Tratamiento.

c) Cumplimiento de obligaciones legales por parte del Responsable del Tratamiento.

5.¿A quién podemos comunicar su información personal?

No se cederán datos a terceros, salvo autorización expresa u obligación legal. Además, para alcanzar la/s finalidade/s arriba/s indicada/s, puede resultar necesario, e inclusive obligatorio, que sus datos tengan que ser comunicados u objeto de otras formas de tratamiento por diferentes proveedores de servicios del Responsable del Tratamiento, tales como asesorías, gestorías, empresas de informática o telecomunicaciones, prestadores de servicios de software, almacenamiento, sistemas operativos y/o aplicaciones o programas informáticos, etc., quienes vendrán obligados a utilizar sus datos, única y exclusivamente, para dar cumplimiento a las obligaciones asumidas con el Responsable del Tratamiento.

En todos los casos, el Responsable del Tratamiento, asume la responsabilidad por la información personal que nos facilite. Por ello solicitamos a aquellas proveedores/empresas con los que compartimos su información personal que apliquen el mismo grado de protección de la información que nosotros.

Asimismo, su información personal estará a disposición de las Administraciones Públicas, Jueces y Tribunales, para la atención de las posibles responsabilidades nacidas del tratamiento de sus datos personales.

6.Transferencias Internacionales

Para el cumplimiento de la/s finalidad/es indicada/s se efectuarán las siguientes transferencias internacionales de sus datos personales (tratamientos en países ajenos al EEE):

En todos los casos: a la sede social del Responsable de Tratamiento, sita en la Suiza. La misma, aporta garantías adecuadas de protección de datos, mediante la Decisión 2000/518/CE de la Comisión, de 26 de julio de 2000.
En determinados casos: a aquellos proveedores/empresas a los que sea necesario ceder o comunicar sus datos personales para tratamientos específicos.

Dichos proveedores/empresas, pueden estar ubicados tanto en países donde la legislación exija un nivel de protección de los datos personales equivalente al del EEE o no. En este último caso, nos aseguraremos de que, toda transferencia de su información personal que realicemos nosotros o aquellos terceros con los que la compartimos, así como la forma en que gestionamos la misma, cumplan con la legislación vigente en cada momento, así como con los requisitos establecidos por la Agencia Española de Protección de Datos y el Supervisor Europeo de Protección de Datos (SEPD).

8.¿Cómo puede ejercer sus derechos?

9.¿Puede retirar el consentimiento?

10.¿De dónde provienen sus datos personales?

Los datos objeto de tratamiento han sido proporcionados por usted y/o obtenidos con su autorización por el Responsable del Tratamiento para el cumplimiento de la/s finalidad/es descritas.

11.¿Dónde puede reclamar en el caso de que considere que no se tratan sus datos correctamente?

12.¿Por cuánto tiempo almacenamos su información personal?

Solo almacenamos su información personal en la medida en que la necesitamos a fin de poder utilizarla conforme la/s finalidad/es por la/s que fue/ron recabada/s, y según la base jurídica del tratamiento.

El plazo máximo de conservación será de 5 años desde la finalización de la relación jurídica con el titular de los datos personales. No obstante, se aplicarán los siguientes plazos específicos de conservación:

Información sobre nuestros servicios: hasta la resolución de las solicitudes de información.
Gestión de candidaturas: 2 años desde que se remita el CV al Responsable del Tratamiento.
Gestión de suscripción al “área de clientes” de la web: 3 años desde el último inicio de sesión, o hasta que manifieste su voluntad de no continuar suscrito al blog (lo que suceda antes).

Mantendremos su información personal mientras usted no ejerza los derechos de supresión, cancelación y/o limitación del tratamiento de sus datos. En estos casos, conservaremos la información debidamente bloqueada, sin darle ningún uso, mientras pueda ser necesaria para el ejercicio o defensa de reclamaciones o pueda derivarse algún tipo de responsabilidad judicial, legal o contractual de su tratamiento, que deba ser atendida y para lo cual sea necesaria su recuperación.

Whereas Swiss-Event24 AG is intending to sell, by electronic means, tickets to all kinds of events and shows and entertainment packages, and considering that the client is interested in purchasing tickets, the parties agree to the following provisions.

Responsibilities of Swiss-Event24 AG.
Swiss-Event24 AG will provide the customer with the services previously agreed to, on the front of this document. Also, Swiss-Event24 AG is responsible for managing the transaction and activity of Customer Service for delivery of tickets. Ticket will be understood as any document, regardless of its format, which permits to attend an Event (ordinary ticket, seasonal ticket, Eticket, etc).

2. Responsibilities of the Client.
The Customer undertakes the responsibility to pay the full price of the tickets for any of the means and terms of payment stipulated on the front of this document. The tickets delivered to the customer cannot be uploaded or sold in any marketplace, website or in the street or close to the event. If this happens tickets can be cancelled and the customer may pay a penalty fee.

3. Limitation of Liability.
Swiss-Event24 AG is not responsible for any changes in the schedule, date, or seat; or for cancellation by the organizer or promoter of the event. Swiss-Event24 AG can offer the Customer superior-category tickets for a failure to meet the entire demand in the category previously agreed upon, whereof will inform the Client. Swiss-Event24 AG ensures that successive tickets are at a minimum in "pairs", i.e. 2 adjacent localities.

5. Price and Payment of the Tickets.
The total amount of the Tickets will be met in full in one payment under the Payment Means and Terms stated in the Front of this document. The Customer shall submit proof of payment made to Swiss-Event24 AG.

6. Method of Delivery.
Swiss-Event24 AG reserves exclusively the right to the form of delivery of the tickets and it will vary under the circumstances and the approximation of the date of the event. The delivery of the tickets can take place up until the day of the event. The Customer must demonstrate conclusively the identity of the person(s) receiving the Tickets. Also, having enacted the receiving of the Tickets, Swiss-Event24 AG is excluded from any liability or fraudulent use thereof.

7. Change in the Ticket Details.
Swiss-Event24 AG is not responsible for any change of seat time, date or cancellation by the organizer or promoter of the event. After satisfying the purchase, the Customer will own the tickets, so it will be the full responsibility of the customer to verify the seat, time, date and other specifications of the tickets before the arrival of the event.

8. Cancellations and Modifications.
Swiss-Event24 AG does not admit cancelations. However, Swiss-Event24 AG, on a case by case basis, at its own criteria and with no obligation before CLIENT and/or third parties, might help to sort out situations on which cancelations had been requested. Should the Customer wish to change the order, Swiss-Event24 AG must also be notified as soon as possible. Swiss-Event24 AG reserves the right to accept changes and modifications requested by the CLIENT to the Customer’s request. If Swiss-Event24 AG does accept the modification, it will notify the Client of any cost that said changes incur, if any.

9. Behaviour.
The promoter or organizer reserves the right to refuse admission to the Customer if the behaviour of the Customer, in the opinion of the promoter or organizer, may cause damage or offense to a third party or the organization itself. Furthermore, the Customer will be responsible for losses, damages, and costs that affect Swiss-Event24 AG resulting from the behaviour. Swiss-Event24 AG may claim compensation until it deems appropriate and necessary.

10. Access to the Event
In the event that the Client cannot access to the place where the Event takes place due to any reasons other than the exercising of the right of admission the promoter or organizer has reserved for itself in each case, the Client must inform Swiss-Event24 AG immediately of this fact and request from the Event promoter or organizer a document in which clearly states that the access to the Event was not allowed and the reason why the entrance was not permitted. The document must be forwarded by the Client to Swiss-Event24 AG as soon as possible.

11. Indemnification to the Customer.
In the event that Swiss-Event24 AG fails in delivering all or some of the tickets, the customer will receive compensation for an equivalent number of undelivered tickets.

12. Duration and Resolution.
This Agreement shall enter into force upon signature by both Parties and shall take effect until the date of full realization of the obligations under this Agreement. In any event, this Agreement may be terminated without notice if the Customer fails to fulfill an essential obligation. In case of default in paying the full price within the prescribed period or in any of its obligations, Swiss-Event24 AG will cancel this Agreement unilaterally and immediately. This does not exclude that Swiss-Event24 AG can separately claim compensation for other damages or lost profits.

13. Protection of Data.

DATA CONTROLLER: Swiss Event 24 AG. MAIN PURPOSE: Management of participation in events, as well as their follow-up, documentation and invoicing. Compliance with legal, accounting, tax and administrative obligations. LAWFUL BASES: Consent, contractual relationship, legitimate interests and legal obligation. RECIPIENTS: No data will be transferred to third parties, except with express authorization or legal obligation or in the case of natural persons and/or legal entities, public or private, whose intervention is necessary to achieve the main purpose(s). International data transfers are envisaged. INDIVIDUAL RIGHTS: right of access, to rectification, to erasure, to data portability, to restrict processing, to object to the processing, to be informed, to revoke
the consent given, to the retention of personal data, to request human intervention or challenge an automated decision-making process and to claim before the AEPD. Arbitration.
Any dispute arising from this Agreement or in relation to it, including any question regarding its existence, validity, or termination, shall be finally settled by arbitration administered by the Law Court of Arbitration of Kanton Zug, in accordance with the Arbitration Rules in effect the date of the request for arbitration. The venue of arbitration shall be the city of Zug in Switzerland.

Covid Information

Prices and availability listed on the website or by email are based considering the 100% filling of the capacity of the stadium. If the booked match is played at reduced capacity and the event organizer is unable to secure tickets in the booked areas due to closures and restrictions, the client will obtain a credit with SwisSports, to use in any event, for the same amount as the order.

If you have purchased tickets for an event that has been cancelled or played behind closed doors for reasons related to COVID-19 or any extraordinary situation, SwisSports offers a credit to use in any event, for the same amount as the order. If the event is postponed and the tickets remain valid for the new date, SwisSports will deliver the tickets for the new date.

No refund if the buyer is unable to attend the event for reasons related to COVID-19 or if the order is executed while restrictions or prohibitions on moving from a particular country at the time of booking, or if such restrictions or prohibitions are issued after booking.

In order to contain the spread of the COVID-19 virus, the Governments themselves, or even the Events Organizers, may have instituted restrictive measures to some destinations and related means of transport.

These restrictions could include:

Additional entry requirements such as filling in forms for locating passengers, public health, both before traveling and on board or at airports or ports of destination in some countries; the request for a negative COVID-19 test before the origin of the trip or even during transit or the european Green pass to be shown at venues entrance.

We kindly ask you to inform all your customers that our company will not be responsible in any way if the customer will not be allowed to enter any event due to the EU Digital COVID Certificate (GREEN PASS) or any other situation outside our company and services. Our company will not be able to provide any refund in case of denied entry to the event country, city, venue or event.
